Changes to DACA

DACA FamilyThe Deferred Action for Childhood Arrivals program was terminated in September of 2017, impacting thousands of people who came to the U.S. before turning 16 years old. In February of the following year, individuals who were previously protected under DACA became permitted by federal courts to renew their status. Be aware that there are no new requests for DACA being accepted at this time.

DACA Renewals

Many people are still interested in renewing their DACA status but are confused about whether they are eligible after all of the recent changes. You may only submit a request for renewal if you had a DACA expiration date on or after September 5, 2017. Individuals who are still eligible to renew his or her DACA status must do so by filing the following documentation:

  • Form I-821D
  • Form I-765
  • The I-765 Worksheet
Can I Work as a DACA Recipient?

If you are a recipient of DACA, you may be eligible to work in the United States as long as you have been authorized to do so. If your DACA protection expires after March 5, 2018, your work authorization will expire on the date that is listed on your approval notice. In the event that the government believes you are no longer eligible for deferred action or work authorization, your status can be terminated. This typically happens when the recipient commits a crime that results in at least 90 days in jail.
